Turkey: Constitutional Court rules continuation of Kurdish politician Aysel Tuğluk’s imprisonment despite ill health

Aysel Tuğluk’s lawyers said that the Constitutional Court rejected the release application for the Kurdish politician despite it stating that her health condition will probably decline and her dementia condition will advance.

Aysel Tuğluk’s lawyers said that the Constitutional Court rejected the release application for the Kurdish politician despite it stating that her health condition will probably decline and her dementia condition will advance, Mezopotamya News Agency (MA) reported on Friday.

The court’s decision contained contradictory statements, lawyers added.

The court stated that according to the reports of Turkey’s Forensic Medicine Institute (ATK), Tuğluk’s health condition did not require release, but in the same statement, it noted also that when Tuğluk’s health reports are examined as a whole, her health condition may decline and her release may be necessary, lawyers said.

The court could not ignore the many documents showing Tuğluk’s declining health condition, and it admitted that her condition would worsen and that she would not be able to sustain her life on her own, lawyers continued.

Meanwhile, the 1000 Women for Aysel Tuğluk platform announced that they do not recognise the Constitutional Court’s decision on Tuğluk with the hashtag #AyselTuğlukTahliyeEdilsin (Release Aysel Tuğluk).

She had been forced to testify in the hearing on 1 August by a court in Ankara despite her dementia diagnosis and deteriorating health, but on 5 August the court ordered her to be released from the Kobanê trial.

However, her detention still continues due to the prison sentence she received in the Democratic Society Congress (DTK) trial in 2018. Her lawyers had therefore applied to the Constitutional Court for her release due to her ill health but the court, on Friday, had rejected the lawyers’ release application.
