Bülent Duran, a member of the Lawyers Association for Freedom (ÖHD), and the lawyer of Şenyaşar family lawyer, spoke to Mesopotamia Agency (MA) about the Şemyaşar case and the investigation. ”Bullets were made to look as if they belonged to Fadıl Şenyaşar without any ballistic examination. Law enforcement officers were assigned to acquit the Yıldız family,” lawyer said.
Four people lost their lives in armed attacks involving an AKP MP during the June 2018 election campaign of the ruling Justice and Development Party (AKP) in the southeastern Urfa (Riha) province.
Emine Şenyaşar lost her husband and two sons as a result of an armed attack by the bodyguards and relatives of the AKP MP İbrahim Halil Yıldız.
Adil Şenyaşar and Celal Şenyaşar were killed at the Suruç Public Hospital where they had been taken for treatment. The father Servet Şenyaşar was also attacked when he entered the hospital and lost his life.
The investigation regarding what happened in the hospital has still not been concluded and there is no lawsuit opened against the Yıldız family nor the bodyguards of the AKP MP Yıldız regarding their role in the killing of three members of Şenyaşar family in the hospital in Urfa.
However, in contrast, a court in Malatya sentenced Fadıl Şenyaşar to 37 years and 9 months and Enver Yıldız to 18 years in prison at the final hearing of the Şenyaşar case trial on 2 April.
‘Police officers fired the 7 out of 17 bullets’
Police officers, who arrived in the scene fired the 7 out of 17 bullets, according to the first investigations report. ”Of course, we do not know where the police shot. There is no clear picture of it. Fadıl Şenyaşar fires only 3 shots. At the point where he fired, his brother Ferit Şenyaşar, was beaten by Kenan and Süleyman Yıldız. Abdurrahman Yıldız and Mustafa Yıldız are also standing in front of them,” Duran said.
“In the final verdict, Fadıl Şenyaşar was accused of killing Mehmet Şah Yıldız, and injuring Abdurrahman, Kenan, Süleyman, Nihat and Mustafa Yıldız. Two of the defendants were sentenced for attempting to kill. All evidence used against Fadıl Şenyaşar was used in order to make him appear as if he is guilty.”
‘There is no evidence that Fadıl Şenyaşar shot Mehmet Şah Yıldız’
Underlining that the prison sentence given to Fadıl Şenyaşar was an “unjust decision”, Duran said, ”There is no evidence or image that Fadıl Şenyaşar shot Mehmet Şah Yıldız by directly aiming at him. It is not acceptable to sentence Fadıl Şenyaşar based on the very limited findings that he killed Yıldız on purpose. This would be clarified with ballistic examination, but such an investigation has never been launched.”
”At the current stage, we see that Enver Yıldız was given a symbolic punishment. The other perpetrators have been set aside and the Yıldız family was partially acquitted.”
